1. Agreement to Terms

These Terms of Use ("Terms") are a legal agreement between you and Rozor 01, LLC ("Rozor 01," "we," "our," or "us"), the operator of The Operator Code platform at theoperatorcode.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. The Operator Code Assessment

2.1 What We Offer

The Site provides access to the Operator Code diagnostic assessment, a self-evaluation tool built around seven performance pillars: Physical, Mental, Tactical, Financial, Relational, Professional, and Legacy. Upon completion, you will receive a results page and, where applicable, follow-up content delivered by email.

2.2 Free and Paid Tiers

The assessment is available in two tiers:

  • Free Tier: Provides access to core assessment questions and a standard results summary.
  • Paid Upgrade: Provides access to an enhanced results report with additional AI-generated personalized insights and recommendations. The paid upgrade is a one-time purchase processed securely through Stripe.

Features available in each tier are subject to change. We reserve the right to modify, limit, or discontinue any tier at any time without prior notice.

2.3 No Account Required

The assessment does not require you to create an account. You complete the assessment as a one-time flow. You are responsible for saving or printing any results you wish to retain. We are not obligated to store or reproduce your results after your session ends.

3. AI-Generated Content and Results

The Operator Code assessment uses artificial intelligence to generate personalized scores, feedback, and recommendations. By completing the assessment, you acknowledge and agree to the following:

  • AI-generated results are produced algorithmically based on your responses. They are informational only.
  • Results are not a substitute for professional advice, including but not limited to medical, psychological, financial, or fitness guidance.
  • We make no warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated output.
  • You are solely responsible for any decisions you make based on your results.
  • Rozor 01, LLC is not liable for any outcomes arising from your interpretation or use of assessment results.

4. Payments and Refunds

4.1 Payments

All payments for the paid upgrade are processed through Stripe. By completing a purchase, you authorize Stripe to charge your selected payment method for the applicable fee. Rozor 01, LLC does not store your payment information. Stripe's terms of service govern all payment processing.

4.2 Refund Policy

All sales are reviewed on a case-by-case basis. There is no automatic right to a refund. If you believe you are entitled to a refund, contact us at hello@clearedhotpodcast.com with your purchase details and reason for the request. We will review your request and respond within a reasonable timeframe. We reserve the right to approve or deny refund requests at our sole discretion.

5. Intellectual Property and Permitted Use

5.1 Ownership

All content on the Site, including but not limited to the assessment framework, questions, scoring methodology, results copy, design, graphics, and AI-generated outputs, is the property of Rozor 01, LLC or its licensors and is protected by applicable intellectual property laws.

5.2 Personal Use Only

Your use of the Site and any results you receive is strictly for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, republish, or resell any portion of the assessment or its results.
  • Use the assessment or its outputs in a commercial context, including coaching, consulting, training programs, or other professional services.
  • Represent AI-generated results as your own original work or as produced by any party other than Rozor 01, LLC.
  • Scrape, copy, or systematically extract content from the Site.

5.3 Licensing Inquiries

If you are a coach, trainer, organization, or other professional interested in using The Operator Code assessment with clients or within a program, contact us at hello@clearedhotpodcast.com to discuss licensing options. Use without an executed license agreement is prohibited.

6. Acceptable Use

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You may not:

  • Submit false, misleading, or fraudulent information during the assessment.
  • Attempt to reverse-engineer, tamper with, or manipulate the assessment or its scoring methodology.
  • Interfere with or disrupt the operation of the Site or its infrastructure.
  • Use automated tools, bots, or scripts to interact with the Site.
  • Violate any applicable law or regulation in connection with your use of the Site.

7. Email Communications

By completing the assessment and providing your email address, you consent to receive assessment results and related follow-up content from Rozor 01, LLC. You may opt out of email communications at any time by clicking the unsubscribe link in any email we send. Opting out will not affect the validity of your assessment results or any prior purchase.

8. Disclaimers

THE SITE AND ALL CONTENT, ASSESSMENTS, AND AI-GENERATED RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ROZOR 01, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We do not warrant that results will meet your expectations or produce any particular outcome.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROZOR 01, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE ASSESSMENT, OR ANY AI-GENERATED RESULTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability to you exceed the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rozor 01, LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party rights.

The Site may contain links to third-party websites or integrate third-party services (such as Stripe for payment processing). We are not responsible for the content, practices, or policies of any third party. Use of third-party services is subject to their respective terms and privacy policies.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Montana. You consent to personal jurisdiction in those courts.

Before initiating any legal action, you agree to contact us at hello@clearedhotpodcast.com and provide a written description of the dispute. We will make a good-faith effort to resolve the matter within thirty (30) days of receiving notice.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rozor 01, LLC regarding your use of the Site. They supersede any prior agreements or understandings, written or oral, relating to the same subject matter.
